EPIRA (R. A. 9136) What is the ELECTRIC POWER INDUSTRY REFORM ACT?

On June 8, 2001, President Gloria Macapagal-Arroyo signed into law Republic Act 9136, or the Electric Power Industry Reform Act of 2001.

This enactment was the culmination of more than seven years of public hearings and floor deliberations on various versions of the said measure in the republican congress.

Among other benefits, RA 9136 is designed to bring down electricity rates and to improve the delivery of power supply to end-users through greater competition and efficiency in the electricity industry.

The essence of these reforms is giving stakeholders a CHOICE, in other words, an advance only to the capitalists.

1.  Consumer Empowerment – the law calls it as the power of the consumers to choose their source of electricity from among a host of generators and suppliers of electricity which the stakeholders themselves organized.

2.  Higher Efficiency –  the law promises to assure the consumers of adequate and reliable power supply at lower rates.

3.  Open Access –  the law promises an open access to transmission and distribution network/ facilities so that the benefits of competition in the generation/supply sector for the benefits of the consumers.

4.  Industry Accountability –  the law promises higher levels of environmental, health and safety standards subject fines and penalties when not strictly complied by the establishments the capitalists create or own.

5.  Competition in Generation and Supply –  all words, all words …

6.  Electricity Tariff  Unbundling –  includes the itemization and the segregation of various components of electricity tariffs to make the rates more transparent.

With rates unbundled, customers will be able to know how much they would be paying for generation, transmission, distribution and other benefits or charges.  As if unbundling means reduction of payments from the consumers.

These reforms are supposedly aimed at making sure our country will have reliable and competitively priced electricity.

The strategy is to put an end to monopolies that breed inefficiency, encourage the entry of many more industry players, and generate competition that will benefit consumers in terms of better rates and services.

In other countries, a restructured and competitive power sector has provided consumers with lower power rates. We look around us and find that the same pattern can be seen in local industries that have been de-monopolized and deregulated like telecommunications and inter-island shipping. 

The privatization or sale of NPC’s generating power plants to several companies will trigger competition, on the generation side.

In addition, its privatization will allow government to shift the burden of ensuring continuous financing for the construction, operation and maintenance of hugely capital-intensive power generating plants to the private sector.

O, paano na ngayon? may nangyari bang maganda? ano ba ang totoong choice  nyo? … ha?… ha? … ha?

and here’s another one … Philippines’ Nampeidai property in Japan, one of the properties acquired by the Philippine government as part of the May 1956 Reparations Agreement with Japan located in Tokyo’s shopping district.

It was during the term of Gloria Macapagal Arroyo, as president,  that the sale of these prime properties in Roppongi, Kobe and Shibuya were initiated, with the Nampeidai property that was eventually sold to a Japanese consortium under a 50-year build-operate-transfer scheme. It took several years of litigation before the successful recovery of the property.

The philippine property located in upscale Fujimi district where the Philippine Ambassador to Japan resides was also slated for sale to pave the way for the construction of a condominium – with plans to just make the Ambassador reside in the penthouse.

While the Fujimi property was not part of the reparations agreement with Japan, it is a prime piece of property, considered a heritage site having once been the home of Baron Zenjiro Yasuda whose family founded the Fuji Group.

The Fujimi property was acquired by the philippine government in 1944, which has since become the official residence of Philippine Ambassadors.

The thought of disposing or selling such a prestigious properties is an act of “stealing the shared cultural and historical rights” of Filipinos and Japanese alike.

As one of our diplomat friends told us, our patrimonial properties are as precious as crown jewels, and once you sell them off, they could never be recovered

These presidential actions, good or bad, can always be done by any president as provided for in the constitution of the land.

at ganito nga ang nangyare … bnoy, officially benigno simeon c. aquino, was given a unique presidential dominance in philippine politics by virtue of the 1935 constitution,  the type of a strong executive that is endowed with extraordinary coercive power and fiscal prerogative with unimaginable dominance …

so deliberately schemed by the americans who were endowed by the europeans, and this brand of power was not accorded even the presidents of the united states, the very same unique dominance given to all mestiso personalities listed in this blog.

cojuangco/aquino can make or break many business enterprises or vitally affect the fortunes of any industry, region or politicians  …. he can enormously influence the entire economy of the nation and can amend the constitution to extend his own term of office …

exactly the same dominance that were abused by presidents ferdinand e. marcos, gloria macapagay arroyo and the rest who came into power.

actually, the said constitution has been amended through plebiscites in the past, but the presidential dominance still remains, such that the cabinent members of the president, who are alter egos, can act like presidents any time and anywhere within the territory of the nation …

kaya nga, walang panama ang mga timawa sa presidential form na gobyerno … hindi maiiwasan ang pangungurakot, dayaan, pulitika at pagpapayaman ng lahat ng mga nanunungkulan at naninilbihan
sa pamahalaan, mula sa pinakamababa hanggang sa pinakamataas …  

dahil sa pagkakaroon ng bagong magdalong saligang-batas na inumpisahan ng mga prisidenting sina emilio aguinaldo, manuel quezon, sergio osmena at manuel roxas …

ito ang resulta ng pakulo ng mga magdalo nina aguinaldo na sinuportahang lubos ng mga intsik at iba pang mga banyagang dayuhan sa pulo ng luzon, para lamang mamatay ang diwa ng magdiwang nina bonifacio ng katipunan, o, ano? hindi ba totoo?
